These Terms and Conditions (“Terms”) govern your use of the website at gebiofuel.com (the “Website”) and of the text messaging program described below (the “SMS Program”), both operated by Green Energy Biofuel LLC (“Green Energy Biofuel,” “we,” “us” or “our”). By using the Website or joining the SMS Program, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or the SMS Program.
1. Who we are
Green Energy Biofuel LLC collects used cooking oil and grease, provides grease trap and industrial cleaning services, and recycles food waste for businesses in South Carolina, North Carolina, Georgia and Tennessee. 2. Using the Website
The Website is intended for businesses and adults aged 18 or older. You agree to use it only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access to it, or submit false information through its forms.
Information on the Website, including descriptions of services, rebates, response times and example savings, is general information. It is not a quote, offer or contract. Pricing, rebates, schedules and service terms for your business are set in your service agreement or written quote, which control if they differ from anything on the Website.
3. SMS messaging program
Program description. Green Energy Biofuel sends text messages to customers and prospective customers who opt in. Messages may include service and pickup scheduling, appointment reminders, account and service notifications, and responses to your questions. If you separately agree to promotional messages, we may also send news about our services and offers.
How you opt in. You join the SMS Program by submitting our opt-in form and checking the consent box, or by otherwise giving us your consent in writing. Consent to receive promotional text messages is not a condition of buying any goods or services from us.
Message frequency. Message frequency varies based on your service schedule and account activity.
Costs. Message and data rates may apply. Check your mobile plan for details. We do not charge for text messages.
How to opt out. Reply STOP to any message to stop receiving text messages from us. We will send one message confirming that you have been unsubscribed, and then you will receive no further messages unless you opt in again. Help. Reply HELP to any message for help, or contact us at (803) 718-6323 or info@gebiofuel.com.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery of messages is not guaranteed.
Your number. You confirm that you are the account holder or an authorized user of the mobile number you provide, and you agree to tell us if you give up or change that number.
Privacy. We do not sell, rent or share your mobile number or SMS opt-in consent with third parties or affiliates for their marketing purposes. See our Privacy Policy for details.
4. Intellectual property
The Website and its content, including text, photos, videos, logos and graphics, belong to Green Energy Biofuel LLC or its licensors. You may view and share pages for your own non-commercial use, but you may not copy, modify or republish the content for commercial purposes without our written permission. Boilerless Technology™ is a trademark of Green Energy Biofuel LLC.
5. Links to other websites
The Website links to and embeds content from other services, such as YouTube, Google Maps, Facebook, Instagram, LinkedIn, news websites and our sister company ReSoil Compost. We do not control those services and are not responsible for their content or practices. Their own terms and privacy policies apply when you use them.
6. Disclaimer
The Website is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties of any kind about the Website, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Website will be uninterrupted, error-free or free of harmful components.
7. Limitation of liability
To the fullest extent permitted by law, Green Energy Biofuel LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising from your use of, or inability to use, the Website or the SMS Program. Our total liability for any claim related to the Website or the SMS Program will not exceed one hundred U.S. dollars (US$100). Some states do not allow these limits, so they may not apply to you. These limits do not apply to services provided under a separate service agreement, which is governed by its own terms.
8. Changes to the Website or these Terms
We may change or discontinue the Website or the SMS Program at any time. We may also update these Terms. When we do, we will change the “Last updated” date above, and for material changes to the SMS Program we will notify participants by text message. Continuing to use the Website or remaining in the SMS Program after a change means you accept the updated Terms.
9. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law rules. Any dispute about the Website or the SMS Program will be brought in the state or federal courts located in South Carolina. Before filing a claim, you agree to contact us first so we can try to resolve the issue informally.
10. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Website and the SMS Program.
